Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tiler Quote mobile application and the tilerquote.com website (together, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Overview

Tiler Quote is a tool for tilers and contractors to calculate materials, labour, and costs, and to generate quotations and invoices. We provide the software and infrastructure; you remain responsible for how you use it in your business.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement.

3. Accounts & Access

  • Some features may require you to create an account or sign in using a third-party provider (such as Google Sign-In).
  • You are responsible for maintaining the confidentiality of your login details and for all activities that occur under your account.
  • You agree to provide accurate information when creating an account and to keep it up to date.
  • We may suspend or terminate access if we believe your account is being used in violation of these Terms or applicable law.

4. Plans, Subscriptions & Payments

  • The Service may offer different tiers (for example: Basic, Pro, Premium) with different features and limits. Plan details may change over time.
  • Paid plans and subscriptions are typically managed through your app store (e.g. Google Play). Billing, renewal, and cancellation are governed by the app store’s terms and policies.
  • Unless stated otherwise, subscriptions renew automatically until you cancel them through your app store account.
  • Refunds are handled in line with the relevant app store policy and applicable law.
  • We may offer promotional or trial access that can be modified or discontinued at any time.

5. Use of the Service

The Service is intended to assist with calculations, quotations, and invoicing. It does not replace your professional judgement or legal/tax advice.

  • You are solely responsible for the accuracy of measurements, rates, taxes, discounts, and all financial details entered into the app.
  • You are responsible for ensuring that your quotations, invoices, and business practices comply with local laws, regulations, and professional standards.
  • We do not guarantee that any calculations, templates, or default values are correct for your specific situation.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal, harmful, or fraudulent activity.
  • Attempt to gain unauthorised access to the Service, other accounts, or underlying systems.
  • Reverse engineer, decompile, or attempt to extract source code from the app or any related components, except as permitted by law.
  • Interfere with or disrupt the normal operation of the Service (including overloaded requests, abuse of free tiers, or automated scraping).

7. Your Content & Ownership

  • You retain ownership of the data and documents you create within Tiler Quote (such as quotations, invoices, and client information).
  • By using optional cloud features (such as exporting or backing up files to your own Google Drive), you grant us a limited licence to process and transmit those files solely for the purpose of providing the Service features you have chosen.
  • You are responsible for ensuring that you have the rights to use and store any content you upload or generate.

8. Our Intellectual Property

The Tiler Quote name, logo, app design, code, and related content are owned by us or our licensors and are protected by copyright, trademark, and other laws. You receive a limited, non-exclusive licence to use the app and website in accordance with these Terms. You may not copy, distribute, or create derivative works from the Service except as permitted by law or with our written permission.

9. Third-Party Services

The Service may integrate with third-party services, such as:

  • Google Sign-In (for authentication).
  • Google Drive (for optional backups and exports).
  • Google Play Billing (for in-app purchases and subscriptions).
  • Ad platforms (for advertising in the Basic plan, if enabled).
  • Analytics and crash-reporting tools (for improving stability and performance).

Your use of these third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services or their actions.

10. Data & Privacy

Our handling of personal data is described in our Privacy Policy. By using the Service, you also agree to that policy.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties or representations about the accuracy, reliability, or availability of the Service.

Without limiting the above, we do not warrant that:

  • The Service will be error-free or uninterrupted.
  • Calculations, suggestions, or templates are suitable for your specific projects.
  • Any exported files or backups will never be lost, corrupted, or inaccessible.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, arising out of or related to your use of the Service.

Where liability cannot be excluded, our total aggregate liability arising out of or in connection with the Service will be limited to the amount you have paid for the Service in the previous three (3) months, or the minimum amount permitted under applicable law.

13. Termination

  • You may stop using the Service at any time and, if applicable, cancel subscriptions through your app store account.
  • We may suspend or terminate your access if you violate these Terms, misuse the Service, or if we are required to do so by law or regulatory authorities.
  • Upon termination, your right to use the Service will cease. Some provisions (such as intellectual property, disclaimers, and limitations of liability) will continue to apply.

14. Changes to the Service and These Terms

We may modify or discontinue features of the Service at any time, including free or trial offerings. We may also update these Terms periodically.

When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice (for example, in-app or on the website). Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of Kenya (without regard to its conflict-of-laws principles), unless another jurisdiction’s mandatory laws apply.
